Long term illness and now redundancy

Not sure if anyone has any advice for me, but I don't know where to turn.

I have been off work since beginning of April, and am currently signed off until mid September. I work for HSBC and have had occupational health referral. I have also had an independent medical assessment through OH and they have said that I won't be able to return to my existing job as it involves too much stress, travel and concentration .... the joy of fibro fog.
I am due to be re-assessed at the end of September with a view to returning to some kind of work on a part time basis, and hopefully local to me as I was commuting to London.

However, yesterday HSBC announced redundancies and I am at risk. I understand that under the Disability Disc Act I will be treated like everyone else - but, normally I would be expected to apply for a similar role. As I have been assessed as not returning to my role, where does that leave me???

I also have a group income protection policy which will pay me an income after October if I am still off work. But, if I am on notice by then and terminated at the end of December, how would that work??? :?

I can feel my shoulders tensing as I write this, and just know it is going to knock me back. I have been feeling so much better being able to nap during the day, and having no stress. :(

Hi Tanya, sorry to hear you are feeling so poorly but worrying about what if 's is going to make you worse. I know its easy for me to say try not to worry but please try, if I were you I would get some advice from CAB or DIAL and then you will know exactly what your rights are :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: you get the outcome you want :goodluck1: :goodluck1: :goodluck1: :goodluck1: :goodluck1: :goodluck1: :hugs: :hugs: :hugs: :hugs: :hugs: :hugs: :hugs:

Sorry to hear what's happening work wise and how you're feeling tanya :hugs: :hugs: If you are a member of a union or staff association, they should be able to advise you about where you stand regarding the possible redundancies and exactly how you are covered by the DDA/Equalities Act 2010.

Has your employer offered you reasonable adjustments to the workplace :nono: Contact you Disability Employment Adviser in your local job centre. Also contact Access to work who can help assess and make these adjustments this is the gov website give them a ring and you can do the interview over the phone http://www.direct.gov.uk/en/DisabledPeo ... DG_4000347

Have a look at your employers policies on Disablity and sickness. If you have been off sick and your pay will be reduced you can argue that your employer has failed to make reasonable adjustments have a look at the meikle case law one site http://www.thompsons.law.co.uk/ltext/l1360003.htm and also this one http://www.pcs.org.uk/en/equality/disab ... tments.cfm

Don't give in to easily :fingerscrossed: :goodluck1: :goodluck2:

Well I was given no option other than to go to London for an interview - this is for a job which I have been signed off from for 14 months (and now for a further 3). No option to have the interview locally - or any other adjustments to take into account my disability.
Not surprised to hear to day that I did not score highly enough and have not been successful, so I will be given 4 months notice.
If I don't find another job internally in that time then I will receive some kind of severance pay.

So I have spoken to the union, and they are taking legal advice for me and talking about an employment tribunal. Joy.
Just all feels very wrong and unfair.

I'm sorry to hear how things have turned out Tanya :grouphug: :grouphug: :grouphug: As well as your union looking into things, maybe ACAS would be able to provide you with some advice, here's the linky to their site http://www.acas.org.uk/index.aspx?articleid=1461

Thought I'd start off the :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: :fingerscrossed: for things eventually being sorted for you, hopefully there will be a lot more added to them for you :grouphug: :grouphug: :grouphug: :grouphug: :grouphug:

I know London's a way to travel for you but I'd advise you to speak to Remploy in London. There's one at Euston, and one at Waterloo (right by Southwark Tube). I used to go to Waterloo and they gave me loads of help and advise with applying for jobs etc. I guess Waterloo is best for you as it's on the Jubilee line, and not many stops away from Canada Square.

I also dealt with a lady there when in work who helped me sort issues out. You have to be referred to Remploy by the Job Centre (ask to speak to a Disability Employment Advisor). But it's worth speaking to them as they may be able to help you find a better role within HSBC.

I used to recruit staff for HSBC in my old job a few years ago. Feel free to PM me and I'll give you the details of contacts at Remploy Waterloo if you get referred to them.

Thanks, that's really helpful.
The union are taking legal advice and I have agreed to an employment tribunal if that is appropriate.

So I will add that to the list along with my ESA appeal and my legal advice over a critical illness policy
Bumpy road ahead I think :yikes:
