The System Finally worked for me!!!!

As Most of you know I have had the system look at my DLA claim again after they used my initial wrong ATOS examination last year. Well I finally got my brown envelope in the post this morning with their decision.

I have been award LRC and LRM. It's pretty much what I expected so, no issues there really. I am soooo relieved though as atleast it is at last recognizing the problems that I have.

:bear-dancing: :woot: :chicken-dance: :clap: :dogrun1: I only wish that I could do this in real life. Oh well I'm a happy bunny anyway.

Thanks to all of you who have been there for me, and listened to all my rants and my worries.

Yup they do, I've got mine from end of October last year, so I'm now awaiting my back payment. CUriously I didn't get told when I would get it, or how I would get paid, I guess that will come in a seperate letter. Anyone else know the answer to that one?

Yeah you will get a letter confirming how much you are due in backdated money and a timescale for when it should be paid. Just out of interest how did you get them to change the decision? Did you ask them for a reconsideration or did you appeal? Just wondering as i am about to fill out the DLA form and apply for it myself, but i am due for a medical for ESA beforehand so i may well find myself in the same situation you were.

HI oorwullie in the first instance they denied because of my ESA medical, but I wrote a full letter (reminding them that my ESA medical had been overturned, as well as stating my present problems) enclosing all of my specialists reports that i had (you know all the ones they send to the doc and send you duplicates of. I have been meticulous in keeping every single one of them. Also at the time of my ESA appeal I had paid for copies of my medical history so I enclosed everything relevant else relevant from that), I also enclosed a copy of the CAB paperwork for my ESA appeal, and a copy of my ESA appeal certificate stating that they had awarded me eighteen points at appeal. I also reminded them in my letter that they hadn't contacted my doctor or my specialists. The other thing that I enclosed a photo copy of is a written statement of what my worst day is like. It was only then that they wrote to my GP and my Consultant. Make sure that both your GP and your consultants are aware of what your average and your worst days are like, the decision will be go a lot on what your GP and Consultants say.
My advice though would be that if you wish to overturn a decision from them that you should state your wish to appeal in the phone call or letter that you make as well as all the other paperwork that you have that is relevant as this will avoid you having to do this twice - also send photocopies of everything (or keep a photocopy of the original paperwork you send, send no other originals) then you will know what you have written.

Having read through the advice of what others have done for successful appeals I am surprised that I have been successful at this point. I would say that others are in a much better place than I am to advise you than what I am. Although I hope that this helps somewhat.

Roseofsharon thats very helpful thanks. It almost sounds like you were planning a military operation, seems thats what its come so that you can actually get what you are entitled to these days. Glad you beat them, kinda gives me hope. :-D
