DLA on reconsideration there is hope!!!

Hi all

I already receive DLA higher rate for care and have done since May 2010, but my mobility has deteriorated since then as i was not awarded anything at the time for mobility. Things have got progressively worse since my award so i plucked up the courage to apply again for the mobility all the time knowing that i could lose what i was already getting for my care by asking them to look at it. Anyway i filled out the form in Jan and sent loads of additional information including copies of all outpatient letters and copies of all treatment i was currently receiving. I also typed a 5 page report on how my life is affected regarding my mobility and gave a copy of this to my gp for it to be scanned onto my medical file.

Despite all of this i was once again refused mobility at any rate as they said that with aids i could walk. I walk with the aid of crutches and in my appeal form i quoted "I walk using crutches, my speed is painful and slow. When my leg goes numb without any warning, the crutches support me they don't decrease my pain" I was so cross that they were choosing to ignore the amount of pain i was in. But i was now ready for the long fight ahead. I sent in my appeal last week and didn't expect to hear anything else for a while. So i was shocked on weds this week to find a letter from DLA saying that they had looked at all the information again and the decision had been changed and that they would now be awarding me mobility higher rate. I still can't believe this, i even went and ordered my mobility car yesterday it is such a relief and will help me so much.

I just want to encourage anyone out there who has been turned down not to give up if you don't get it 1st time fight it all the way. I was ready to go to tribunal even though i was told by CAB that they wouldn't represent me and that i would have to fight it alone or get alterative representation as they didn't have the funding in this area, i am so pleased that i persevered with it. Don't get me wrong i did consider just letting it go and accepting what they said but i felt so strongly about it about i wasn't prepared to do that.

Fight it all the way and claim for what is rightfully due to you!!! :yikes: :yikes:

Thank you to all that have kept me going throughout all of this i couldn't have done this without all the help and support that this site gives!!!!!

well done hun, mines in the process of being appealed, just waiting to hear back, i used to just get high rate mobility, then got the forms back the next time with low rate care indefinate and no mobility! my gp wasnt very impressed with that, she wrote a really good report and told me to appeal, i wasnt going too as didnt feel i had the strength.

reading your post has made me feel more positive in that i may get some back, i like you use crutches and more a wheel chair now, they said the same to me cause i use aids to help so i can walk!

anyway hopefully ill hear back soon and hopefully with a positive result

well i neen help i get high mobility and low for care but the last few months i was diognosed with fibromyalgia nd ive got a job to care for myself my daughter helps i updated my claim and they kept it as low for care i need sooo much help with care its unbelievable but dident do nothing about it so gonna claim gain soon

well done and congratulations.

would you mind telling us what you sent in for recond. i know we are all different but were any reports more helpful. or was it just your perception of pain emphasis.

sorry to ask but i have sent in so much stuff from specialists and gps, hydro etc but not got any mobility.

went to cab recently as he said less is more sometimes so don;t know if i just bombarded them with too much before or if it was too early days when i first applied anyway we keep fighting.

Thank you all for your replies. I sent in copies of all tests/investigations/all appointment letters and included a letter from my gp and a typed letter/diary explaining how everything affects me. Yes i did empathise on the pain as i am never free of pain. I do have other problems as well as fibro i have severe crohn's disease and rely on help with nutrition, i also have osteoporosis and diabetes that is steroid induced which i need to keep the crohn's at bay and also uncontrolled high blood pressure. On my award dwp have obviously contacted 3 of the consultants that i see regular or that is what it says. I was totally shocked that i got this on reconsideration and expected it would go to tribunal as it did for the care component for which i also get higher rate now. This is the most detailed application that i have ever done so my advice is to send everything it could save you the stress of going to tribunal. I also read all the information on benefits and work site which have been invaluable at helping me to describe my disabilty thoroughly.

Good luck to all of you that are waiting but it just shows that they can change the decision before it goes to tribunal!!!!
