DLA PARTIAL SUCCESS. ASKED FOR RECONSIDERATION.

Hi peeps, hope you are all having a good day. I have been claiming DLA for the last 2 and a half years and was awarded High Rate Mobility and Mid Rate Care. Today I received the award for my lastest application, they have awarded me High Rate Care and Low Rate Care. On the letter they sent to me they say they have made their dicision based on the evidence I supplied them with, what my GP has written on the statement from someone who knows you part of the Dla Form and my ESA medical. Its says on the letter that I am not at risk of falling and not at risk of dizzy spells and that I can sleep comfortably despite me sending them a mountain of evidence confirming otherwise so I cannot see how they can logically arrive at the conclusion they have unless they did not read the evidence i supplied. I have now written to them asking for a reconsideration and have sent them all my documents and medical reports from doctors/specialists again this time highlighting the relevant evidence and information on each report. I have sent them a copy of the statement from my GP that she has written stating I suffer from falls and she has underlined this. I also have sent 3 other letters from specialists that state I suffer from falls. I have sent them 6 reports that state I suffer from profound dizziness, 5 from specialists and 1 from my GP and also part of my ESA medical report that states I suffer from dizziness. I have sent them 7 reports that confirm I suffer from severe balance problems and unsteadyness, that I stumble and drag my feet and that I need to use 2 crutches to walk. 5 from specialists, 1 from my GP and one from my ESA medical report. Finally I have sent them 4 reports confirming that I suffer severe problems sleeping and need to get up several times during the night due to pain etc. 2 from specialists, 1 from my GP and one from my ESA medical report. What do you guys think my chances are of getting my mid rate care back? The evidence I have sent seems overwhelming.

Forgot to say I also sent in a report from a specialist stating I need help washing, dressing etc.

sounds like you have sent a good range of evidence.

however sometimes it can be what you have also said, you havewn't sent anything else that may contradict anything you have stated.

think carefully as they like to catch you out where they can and good luck.

As long as all the reports state it is the doctors opinion you have this and don't say ' oorwillie complains or advises he is dizzy on a frequent basis ' , which then becomes your opinion in their eyes , then you should be fine. There's always the risk you can lose the award completely but should be unlikely from what you've said.

Hi guys, thanks for the replies. Thats pretty much what I thought as well. My forms and information and evidence are consistent and all reports sent regarding disabilites and problems I have are observations the docs have made. Guess I'll just have to keep my fingers crossed.

Well I have received a letter today from DWP confirming that they have received my letter asking for a reconsideration and are now looking again at all the information and evidence. Does say on the letter that it can take up to 11 weeks for a decision though! Wish me luck!
