Atos report after DLA award.

Hello all, After I was awarded Higher Rate DLA till next year, I asked for a copy of the report that Atos did during my home visit. I don't agree with everything that he put in the report and he changed some of the I formation that ad given to him on the day, I did record the conversation when they were here, them not knowing.

Shall I take this up with Atos or just be thankful I wa awarded both components higher rate??

First off im not sure you can present information from a secret recording??? Im sure you have to notify them that you will be recording the session so again unsure if it will be acceptable and just maybe you may get into trouble for doing this without there knowledge/permission :dunno: so i would look into that first as you dont want to be making the situation worse.

You have higher rates of the DLA and so i would be grateful just to get that and to let it be as no matter what was said in the end you got what you needed and it didnt jepodise the claim.

Maybe others have more answers for you.

Hi Lisa...you might be up the stuffer re your recording, about the only thing you can say is you recorded it as your memory is soo poor you can't remember a lot of things so this was done to help you remember what was said...for personal use. you might get better advice on a site such as 4UP or fightback. Be careful what you say to dwp..i can understand why you did it though, i'd do the same, but you need to cover yourself.
EVERYTHING that was wrong...copy the report and tell them all the lies that were in it, list it out and cross reference it if you can..however as you were awarded high rate it might not be worth it.
You can always keep it for future reference though

Many years ago I took dwp to tribuneral on behalf of my autistic son. It was a bitter battle even in the tribuneral ( the panel were very good) as the point in law I was arguing was a potential land mark and was set to clarify a high court ruling in a case that was being used by dwp as a benchmark to turn down dla mobility for autism.... Dwp,education etc lied...I took evidence that proved it.....that was nearly 20 years ago. Since then I have had my daughter renamed,my self written off the face of the earth, in number removed,changed and my husband married to someone else. I've been refused speech to dwp because I'm not the imaginary persons they remarried my husband to despite having my passport,driving licence and marriage certificate. I was even refused self employment as my in number was re assigned. Even when resolved I never got a straight answe because the documents were the archived ( the point of archiving is so they can be got if needed) . I've had every move of house,change of job etc ,child benefit claim etc mucked about with, refused dla ,dla appeal stopped changed panels and refused. Second tier tribuneral turned Down as they said although there was a branch of law they'd have made the same decision anyway as 5 specialist reports weren't plausible despite being specific and backed up with 30 years of medical background and evidence. A year waiting on esa assessment weeks decision ... The list is endless and frightening. I am convinced totally this is directly due to me taking on the dwp and winning and op inf the flood gates to their incorrect use of a high court ruling. The tribuneral were so outraged and concerned at the dwp attitude and approach even at the tribuneral,they even locked the dla decision for my son until he was 18! I am totally sure my files have been marked and I have at every single turn been persecuted for that. So my advice would be, be glad of the decision, keep the tape and evidence safe in case of future need.....but for goodness sake DON'T poke the hornets nest! Xx

Thank you so much for all your relies, You just confirmed to me that it is probably better to ignore the discrepancies. I did only record the visit for my record and wasn't going to use it as evidence, just made notes from it on crucial points and then deleted the conversation.

I still think you are making the right decison not to use the recording but given you recorded the session when they were invited into your on to your property rather than thiers might make a difference as to whether you could have used it.
