ESA Support Group

Postby lala » Wed Mar 19, 2014 10:32 pm

Hi, I had to give up work last june due to Fibro and Mental Health Illnesses and they placed me in the Support Group for ESA, but I am claiming the ESA when they don't take your savings into account. Will this benefit only be paid for one year or is it an ongoing thing? I get lower mob DLA and medium care. Any advice would be great, thanks.

If I'm right in thinking that you're claiming contributions~based ESA, then with you being placed in the Support Group, it means your benefit will continue to be paid while you're in the Support Group.

ESA(C) is paid for 365 days for those who claim it and are placed in WRAG.

Make an appointment with CAB/DIAL or your local welfare department and explain your situation see if they can give you some practical help

Lala if you are in the support group then your money doesnt stop after a year it carries on as long as you are in the support group, WRAG is work related activity group which most people are placed into, this group are the people that the DWP feel can go back to work if they get some specialist support.

The support group however are those who the DWP does not feel are well enough for work AT THE MOMENT these are basically left alone until the DWP feel they should be reviewed again to see if anything has changed

Hope this helps, brain is a bit fuddled tonight :-D :-D :-D

When you say you failed your appeal do you mean at an appeal Tribunal ? If it is a failed Tribunal appeal you can't make a further appeal unless on a point of law which is complicated and you would need specialist help with this from CAB.or equivalent.

After losing an appeal at a Tribunal you can start a new ESA claim as long as there has been 6 months between initially failing your assess sent and the Tribunal. The only situation which can be a problem with this route is if you aren't entitled to means tested benefits eg you have a partner who works and you've already used up your 365 days ESA entitlement of NI contributions.

Debbie has it been 6 months since you had your "medical"? If so you can reapply for ESA.

Hi Lessa thank you for that, even though I was told in a post before I must admit I didnt take it in, the pain just stops me from fuctioning. I now have my new esa form to fill in and wonder who I should get to help me fill it in.... I went to cab for the last one and dont think the lady although was very nice had much experience. She also said she would come to the tribunal with me but changed mind at the eleventh hour. Any advice would be great,
Thank you, Debbie

Debbie, various people can help. Sometimes your local housing benefit office will have a welfare officer who.can help, D.I.A.L. may have an office in your area who.could help. If you are on facebook there is a group called fightback (they also.have a website) who can either help you fill the form or can check it after you've done it.

lessa thanks again for advice I am going to start to do it now while my head is fairly clear. I just hope they do not say that I am not entitled to claim again once I have done it all.
