Claiming ESA whilst claiming a works pension.

I rang then wrote to ESA to inform them my circumstances have changed and I am now in receipt of a works pension. My main letter with all the details would have reached them around the beginning of January 2014.
I contacted them on Thursday (17/4/2014) when I was informed that there was a back load of claims dealing with ESA & works pensions and that they would in all probability not start the reassessment of these type of claims until June/July 2014. Yyyy they are still paying me my original ESA claim every 2 weeks. Ul.
I am scared when they eventually review my claim that I will owe a substancial sum of money has anyone else been in this position and what happened?

If your pension is above the amount to get ESA than i would not touch my ESA untill it is all sorted out. This way if you have to pay any back you are covered uc all us ok than you have a nice pot of money to play with. I know this can be hard to do but worth a go. Have you tried to ring job centre they may beable to help you or citizens advice?

You are allowed to keep £85 of your private pension per week and then ESA will drop by 50% or 50p in every £ after that. You are allowed some savings as well, i think the amount as gone up so not sure what it is now but last year it was £6,000.

was/am in similar position

since summer last year I receive a smallish work pension
told ESA about it in writing
still get full ESA every 2 weeks
informed Inland Revenue about my changes
I now pay tax on my pension because my income is both, ESA and pension

I thought ESA would stop as soon as I receive my pension
maybe because it is not a state pension?
my ESA advisor is aware of it, also in writing

anyway, Housing benefit takes both incomes into consideration
as far as I am concerned I covered my back

would suggest to get in contact with IR to pay tax in case your combined income exceeds

i claim a company pension and esa they take so much per pound i think 40 pence i have a good pension and when it increases every year i send them the letter and they adjust my esa

It's just so complicated claiming any benefit . Thankfully I've only ever claimed CB incap benefit now migrated to ESA CB in SG. I've an occ pension but have transitional protection so it doesn't affect my ESA payments until either 2018 or poss 2020. The tax I would pay on my ESA is deducted by the company who administer my Occ pension.

I feel very sympathetic towards anyone relying on a range of benefits as it must be a nightmare , every year you read several threads of people with tax credit or HB overpayments caused by misunderstandings of this complex system. Maybe the UC system which supposedly joins them all up will help if it ever gets sorted and up and running.

In all dealings with DWP or Hmrc suggest you keep a copy of all letters sent advising them of changes

received a letter today from DWP/JobCenterPlus stating:
...we cannot pay you ESA from 26 September 2013 ...
...a change of money coming in ...
and so on

it took them about 9 month to process my change of income (work pension)
the letter doesn't state anything about paying back plan etc yet

this effects the claim for housing benefit for the last 9 month, which I would have to back date claim (because income now without ESA since 9 month) however long this will take
plus claiming back tax I paid on my pension ...

luckily I didn't spend the "extra money", still I am not willing to pay anything back until HB and tax are sorted

what annoys me most is all the added work :pull-hair:

I don't want anything which I am not entitled to
that's why I informed all the different departments about everything exactly when it happened
hoping each one would know "how the system works" and do their bit

each of these departments seem to live in their own little :crazy: bubble :easter3:
