Will current sick note affect JSA claim?

So i failed my ESA medical assessment with ATOS and now have a JSA meeting set up on Monday. I've spoken to my doctor who won't sign me off sick so my current sick paper is still active. I'm now worried i won't be on JSA either as i'm too sick. I'm scared i'll be without money which, despite being single and living at home, i can't be without money. The guy who spoke to me on the phone from the jobcentre said i could go on JSA with the conditions of ESA. Is that right?

I 100% plan to appeal should my reconsideration fail. I have the support of my doctor who is tamping that i didn't get any score at all. I'm just worried i'll be without money :-( Any advice would be great!

Can't appeal until after the reconsideration. Need the paperwork before i can ask for one though although the guy i spoke to at the jobcentre call centre said he was putting a request in for me but forgot to ask if he did or not. I'm just confused since different places say different things. I live at home and haven't worked so was on income based ESA. I just want an idea. Obviously on Monday i'll report my findings but just confused at the moment.

I didn't have any trouble getting my ESA. Or DLA. When I was diagnosed by a specialist whichbmy gp arranged I had no problems,.

What I did was go on line and print out all the information about Fibro. And I attached it to ever claim I made. Get or go to send you to a specialist who will provide you with a letter confirming you have fibro.

Had a letter confirming fibro from the rhumatologist after i saw her last year and she stated on that letter i was unfit for work. Problem is because i'm waiting to go to the pain clinic appointment i can't be on the rhumatologist list at the same time so another letter from her isn't possible at the moment. I just thought they would have waited until the pain clinic appointment to see what they had to say. I have a right mind to ask my doctors surgery if ATOS contacted them after. Would be interesting to find out. May even ask if the rhumatologist office to see if they had anything. Wouldn't surprise me if they hadn't contacted any of them.

Got those already. Just had my report- some things haven't been mentioned, some things failed to say how painful/difficult it was, some hasn't been explained properly and some are outright lies. Will be fun to tear this apart along with the recording as back up! The fight will now begin!

i can no longer claim because i had been on ESA for 12 months and apparently have not paid in enough contributions. So i get nothing because my partner earns too much, little do they realize he earns that amount due to him having to work all hours god sends for us to make ends meet. i did start to claim JSA but because i was ill and didn't make my sign on time i had to go through all the process again, this was where i was informed that i was claiming the wrong benefit and they took me off JSA only for me to find out i can't claim anything. i still have to send in sick notes as they pay my stamp but that is it. i am waiting to hear from atos about my claim for pip but i ain't holding my breath. so as you can imagine this as not helped my condition at all. SO SO angry at this system, makes my blood boil :(

As you've technically been declared fit to work, they can't refuse you signing on for JSA until your MR reconsideration has been done. The JCP are well experienced now in people having to sign on for JSA temporarily after failing an assessment. And many are very reasonable with this type of claimant.

It's important you ask for reasonable adjustments to be put into your JOb Seekers Agreement which reflect your condition. To avoid the possibilities of being sanctioned. But be careful , they must be reasonable eg if you say you can only work 4 hours a week they can refuse to allow you to sign on. Or if you arrive waving your sick line as proof of being unfit to work, also saying you are unfit they can then refuse you. As the condition of receiving JSA is to look for work.

Remeber there are over a million fit and healthy job seekers, who can't find work. All you have to do for a short time is meet the conditions of whatever job seeker agreement you've made . It's unlikely you're going to be asked for any interviews. If Your MR doesn't reverse the decision you can then make an appeal directly to the Tribunal and switch back to ESA and ask for interim appeal payments. At which point you'll need a new sick line to send in.
