Absolutely Awful ESA Tribunal

Hi all

I was diagnosed with fibromyalgia around 3 years ago.

I was on ESA for over 11 years until this Feb 2017 when I was found fit for work. What angers me even more is I was awarded the Support Group only 2 1/2 years ago - and the evidence provided was 90% the same.

I have gone thru the Mandatory Reconsideration but I unsuccessful at this as well.

Yesterday, the 24th July, I went to the ESA Tribunal but the hearing could not proceed as I had a panic attack and needed a bag to be able to breathe in. I stated that my father passed away in May to which the Judge's comments were as callous as they could be - 'that's quite some time ago now' like bereavement has a timescale. I suffer with stress and anxiety at the best of times and as I have had virtually no support in regards to this, I am REALLY struggling. I have tried the local mental health, the CAB, charity groups and so on but apart from someone else going with me for morale there's literally no help due to resource cuts.

The Judge even stated that 'if I am likely to panic attack at the next hearing then I have to bring my own paper bag'! which shows how genuinely evil this whole process is. I feel that the tribunal will be a kangaroo court as I get the vibes that my health conditions are infact irrelevant and they're gunning to disallow at the earliest convenience even though I have 2 letters from my mental health specialist, my GP advising Rule 29 applies, the fibromyalgia specialist and so on.

I am beyond terrified here with no idea as to what to do. I want to file a serious complaint about how callous and ignorant that judge who - as far as I am concerned - has no idea about disability whatsoever and is merely a hired mercenary to remove benefits from those in need as fast as she can.

Any thoughts would be appreciated.....

I would look into a complaint, how disrespectfull! :evil: :nono: Im sure the CAB can help you with that.

It maybe too late but some charitys / organisations will attend the trinual hearing with you. You will need to look whats available in your area.

As far as the ESA goes, have you obtained the DWP decision report to see why they have made there decision after being so long in the support group? If not call DWP and get one!
