I really need as much help and advice please. I have just had my date through for my appeal tribunal which is just four weeks away, December 6th but I am on my own, have no one to help me, have no paperwork from any specialists (never sent to any) my doctor wont provide a letter or anything (saying he will supply when asked by the appeal court) and I dont know what to do. I dont have anyone that can come with me and feel that my appeal is doomed before it even starts. Please help me to get through this. I am panicking and getting myself in a right state and I only had my letter an hour ago. Thank you

Phobe cat firstly ring council see if they have a benefits advice officer if they do not ask if they know of a local benefits advocy, failing that contact fightback on face book see if they can supply some advice.

Your not alone as groups like fightback are here to help and they have had numerous success stories on appeals and am sure they can help

I know how you feel. I'm in pretty much the same position. My tribunal is 22nd November and our local health authority refuse to write any letters with regards to benefits claims. What I have done is ask for parts of my medical records, specifically any letters from my consultant to my GP. I had to ask the practice manager in writing and pay an admin charge. My Dad came to my Atos assessment and will be at the tribunal with me which will give me strength.
I have considered going to the CAB but I have so little time to prepare and I'm not sure that there is anything anyone can do at this point.

First of all, see who you have in your area, such as CAB, DIAL, or other organisation/grioups that help with benefits advice. They may have someone who can help you, and maybe even go with you and represent you at the hearing. At the very least they may be able to give you some advice about getting things together that might help your appeal.

Speak to the admin staff at your surgery about having a look thru your medical notes. There may be some bits and pieces you could have copied to use in your appeal. There may be some charges involved for doing this, esp having copies made.

You haven't said which benefit it is that your appeal relates to. If it is for have a look at this linky. I've also found this pdf which you can either open up and read on here or download and read at a more suitable time. There are some letter templates in it, one of which is for requesting medical info, which may be helpful with what you have mentioned about your GP.

If your appeal relates to another benefit, let me know and I'll see if I can find something relating to appeals for it.

Well, we have no DIAL where I live and I have just spent nearly 3 hours at CAB to be told that there is nothing they can do to help me but if I fail the appeal, to go back to them. Fightback sent me a message, telling me to read through all the old posts to see if I could find anything that might help but my laptop is so old and so slow that it wont let me do things like that and even if it did, the way my head is and the way I am unable to concentrate on anything for more than a few seconds, I would find it impossible. It is looking like I shall have to attend on my own with no support or back up from any one or any paperwork. I really am getting myself so worked up about it, I know that I will be a wreck on he day and will be in no state to get myself through it all

Hi, Ask at your GP surgery for a print out of your medical note, you have to put it in writing, and there is an admin charge of £10 at least that's what it is in my area. tell them you want it by next week,( I asked for mine from 07/2006 to the present as that's when my problems started) then photo copy them, and post the copies to the tribunal, you can take them with you on the day, but they don't like this, as it don't give them a chance to read through them and may delay a decision.

Certainly you've left things a bit late but take a deep breath and calm down, you can still do this yourself, if you focus now. .

Have you identified what ESA descriptors you fit and why?

Have you read the ESA85 assessors report which you'd have received as part of your appeal bundle? And identified the assessors info which you disagree with relelvant to the descriptors you meet?

Have you read the link provided by FP yet?

Have you asked for a copy of your medical file as suggested by scartlass?

Also forgot FP can you possibly give a link to a template appeal letter for Phoebe from this site which shows basic layout ? There's one on the CAG forum as a sticky in the Benefits and Works forum, but my link provision skills are less than inept.

There is also a simple template in the pdf I attached, so depending on your writing style PhoebeCat, have a look and see which one would suit you best, or use them for ideas and put one together.

There are also questionnaires to be sent to your GP and anyone else you might see asking for them to complete them, explaining how you are affected etc. By using them it will mean you have some paperwork to submit to help with things :fingerscrossed: :fingerscrossed: :fingerscrossed:

I have asked for my medical records and am waiting to hear back from them. I struggle to be able to concentrate when reading the links that you have all been helpful in attaching for me. I am doing my best but the more I try to read them and take in the information, the worse it is making me feel and my concentration gets worse. One thing I have noticed is the mention of a DWP Decision Maker and receiving a letter back from them with their decision about my appeal but I have never had that. I received my Atos report, appealed about their decision and am now going to an appeal tribunal. Should I have received something else or is it quite normal to go straight to an appeal? I wish I had someone else who could help me through this, I feel completely lost and out of my depth.

It's a DWP Decision Maker that decides which fate you will be given when you send in your claim for ESA. Then, when you challenge a decision, it will be a different DWP Decision Maker who looks at it for a reconsideration as to whether the decision can be changed in your favour or not. You should have received a letter about this if your claim was sent for reconsideration. If the decision can't be changed in your favour, then your claim will be entered into the Appeals system.

With you finding the linkys difficult to read, you could always either copy and paste or download the templates etc to your pooter and save them so that you can have a read of them at your own speed.

Wrt someone to help you, have you thought of contacting your local council, as they should have info about groups/organisations in your area that might be able to help. They may even have their advisers who could help you with this.

Many thanks FP for providing Phoebe with the links to appeal letter layout templates.

Phoebe, forums provide advice to point people in the direction of self help, if you can't cope then you'll need to try and find someone in an advisory service who can help you with it.

You haven't answered the questions I asked you earlier,- do you know what descriptors your condition meets.

- Have you identified the areas in the assessors ATOS report relevant to the descriptors you meet which you don't agree with.

If you know the above , then you have the basis to make your appeal.

I have been in touch with my local council and they have no one that can help me out nor can they put me in touch with any other organisation etc that can.

Zappa20, sorry I havent answered your question as to what descriptors my condition meets etc, this has a lot to do with the fact that every time I read your question, I burst in to tears because I have to admit that if I'm honest, the way I am with my head, I cant even understand what you are asking or what I should know and if I cant even do that, how on earth am I going to get through this on my own or be expected to go to work and train for a new job or get through a job on a daily basis? You say that I would have the basis for my appeal but how? Sorry but I think I am going to need everything spelt out for me, otherwise, I am not going to be able to cope and I know that I am running out of time.

You can ring the DWP and ask for an extension, explain what has happened and how you cant fill in the form yourself and that you cant find anyone to help you with it and they may offer you help or direction at least, unfortunately we can fill your form in for you or tell you what to put as we dont know how you are affected. :( :( :( :( :(
